A court has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment lacks lawful basis.

"Since his return from wrongful detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her ruling.

The situation originates in a mistaken deportation to El Salvador in March, which US authorities later acknowledged was an error. Following his return to the United States to answer human smuggling allegations, he was held in immigration detention.

In her decision, the court noted that the government does not have a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."

Context of the Legal Challenge

The legal proceedings involve disputed claims. While the Trump administration contends that Abrego Garcia is a affiliate of the MS-13 criminal organization, he vehemently disputes this claim.

He has also pleaded not guilty to the smuggling counts, which are part of a separate criminal case in the state of Tennessee.

The court, who was hearing his challenge to removal in a Maryland district court, determined that he must now adhere to the terms of his bond from jail in Tennessee. This order shifts his monitoring to the Tennessee court.
